Our position

Horizon Books is a print-on-demand publishing services provider. We manufacture copies to an author's order and host e-book downloads with an author's written consent. We do not commission works, we do not acquire rights in them, and we do not read, evaluate, edit or clear them.

We therefore have no independent knowledge of whether a work infringes anyone's rights. We depend on the author's warranties and on complaints from rights owners. When a rights owner comes forward, we act — promptly, in writing, and without taking sides on the merits.

Who owns what

2.1 The author owns the copyright in their work. We do not, and we make no claim to it.

2.2 We own only the horizonbooks.asia website, our name, logo and imprint, our catalogue design and our own original marketing material. These may not be used without permission.

2.3 An ISBN issued for a work identifies the edition. It is not evidence of copyright ownership, and it is not conferred by us.

2.4 The appearance of a work under our imprint does not mean we hold, checked, or endorse any claim of ownership in it.

Authors: what we require of you

Before we produce or host a work, you must give us a signed Copyright Declaration confirming that you own the rights or hold a written licence covering everything you have asked us to do. We may ask to see the underlying documents at any time, and we may hold production until we get them.

You must disclose to us, in writing, if any of the following is true

• The work reproduces, edits, annotates, abridges, translates or comments on an existing work by someone else.
• The work has been published before, in any form, by anyone.
• The work contains any third-party text, images, photographs, figures, tables, datasets or fonts.
• The original author of any underlying material is deceased, or their identity is uncertain.
• Rights in the work are shared, disputed, or held jointly with anyone.

Non-disclosure is a breach of our Terms and triggers the indemnity in clause 10 of those Terms.

Public domain and older works

An old work is not automatically a free work. Under the Copyright Act, 1957, copyright in a published literary work generally lasts for sixty years counted from the beginning of the calendar year following the author's death. A book first published decades ago may still be protected, and rights may sit with the author's legal heirs.

If you tell us a work is in the public domain, you must be able to show the basis for it — normally the author's identity and date of death, or the date of first publication where the term runs from that. A traditional-sounding title, an archaic style or an unfamiliar author is not a basis.

Adaptations, translations and commentaries

5.1 Editing, annotating, translating or writing a commentary on an existing work creates rights in your new material. It does not create any right in the underlying work.

5.2 If the underlying work is still in copyright, an edition that reproduces it needs a licence from its owner, however substantial or scholarly your own contribution may be.

5.3 Submitting an edited or annotated edition to us is a representation that you hold that licence. Please attach it.

Filing an infringement complaint

Write to bookshorizon@gmail.com with the subject line "Copyright Complaint". To let us act quickly, please include:

Your details	Name, postal address, email and phone number.
Your capacity	Whether you are the owner, an heir, an assignee, or an authorised agent — and, if not the original author, how the rights came to you.
The protected work	Title, author, year of first publication, and a copy or extract of it.
Proof of ownership	Registration certificate if any, publishing agreement, assignment, will, succession certificate, or other document supporting your claim. Registration is not compulsory in India, so its absence is not fatal — but something supporting the chain of title helps.
The material complained of	Title, author or editor, ISBN if known, and the URL on our website.
What overlaps	Which parts of your work you say have been reproduced, as specifically as you can.
Statements	That you believe in good faith the use is unauthorised, and that the information you have given is accurate.
Signature	Physical or electronic.

Send what you have. If something is missing we will ask, rather than reject the complaint.

What we do when a complaint arrives

7.1 Within 24 hours — we acknowledge receipt in writing and register the complaint with a reference number.

7.2 Where the complaint is substantiated on its face — we suspend the e-book listing and stop accepting new print orders for that work, as a protective step while we look into it. This is not an admission that infringement occurred, by us or by the author.

7.3 Within 3 working days — we forward the complaint to the author and require a substantive response, with supporting documents, within 7 days.

7.4 On request from a complainant whose claim is substantiated — we provide a true account of what was actually produced and distributed by us: the print quantity, who took delivery, the number of downloads, and the amounts received.

7.5 Within 15 days — we communicate an outcome in writing to both sides. The outcome may be permanent removal, restoration on the author producing a licence, or continued suspension pending resolution between the parties.

7.6 We do not adjudicate ownership. Where both sides maintain their positions, the listing stays down until they resolve it between themselves or a court decides.

Author's counter-statement

An author whose work is suspended may send a counter-statement setting out why the use is lawful — a licence, a no-objection certificate, an assignment, evidence that the term of protection has expired, or that the material is original.

We will share it with the complainant. If it answers the complaint and the complainant does not press the matter within 15 days, we may restore the listing. If the complainant maintains the claim, the work stays down.

Court and governmental orders

On receiving an order from a court of competent jurisdiction or a notification from an authorised government agency, we act on it within the time the law requires, and in any event no later than 36 hours where that is the applicable standard. We do not require a complainant to obtain an order before we will act on a substantiated complaint — but where one exists, it is decisive.

We preserve production files, order records and correspondence relating to a complained-of work, and produce them when lawfully required.

Repeat infringers

Where an author is the subject of more than one substantiated complaint, we may terminate their account, delist every work associated with them, and decline further business. We may recover from that author all costs we incur under the indemnity in our Terms.

Misuse of this procedure

This procedure exists to protect genuine rights owners. Filing a knowingly false or bad-faith complaint — to suppress a competitor, to extract money, or to obtain a work's commercial data — is an abuse of it, and may itself give rise to liability. We may decline to act on complaints that appear to be made in bad faith, and we will say so in writing when we do.
